In early 2021, the US Department of Health and Human Services (HHS) issued a Notice of Proposed Rulemaking (NPRM) containing a proposed modification to the HIPAA Privacy Rule in order to support and remove barriers to coordinated care and individual engagement. This proposed rule would require covered entities that respond to patient directives for protected health information to charge the patient rate for third-party directives. This session will analyze the economic impact of the proposed modifications to HIPAA, as summarized by a recent cost-shift study conducted by the Association of Health Information Outsourcing Services (AHIOS). Speakers will address the concerns this proposal raises, which could exceed $1 billion in cost shifts from commercial third-party requesters to hospitals, physician groups, and other outpatient service providers. Attendees should walk away with an understanding of how these cost shifts could potentially impact their organization which will enable them to lead conversations within their organization.
